Prüm: A Model 'Prêt-à-Exporter'?
The 2008 German–US Agreement on Data Exchange
This study analyzes the position of relevant actors and their capacity to increase their powers or to quell resistance during the process of extra-territorialisation of security measures based on data access. It deals with the process of extra-territorialisation of the Prüm Treaty, a European set of security measures enhancing, inter alia, the exchange of personal data. Given the series of legal instruments developed on the basis of the Prüm Treaty provisions, the paper questions the creation of a "Prüm model" and analyzes its features in order to outline and discuss a possible model of extra-territorialisation.
