Debating Law & Religion: The Rule of Law in South Asia
In this video, Christophe Jaffrelot and Sudhir Krishnaswamy discuss how India and Pakistan embarked on separate constitutional journeys in 1947, which then shaped their differing conceptions of the rule of law. However, to characterize their respective approaches as 'secular' and 'religious' is just too tidy. If religion is now eroding the rule of law across South Asia, which appears to be the case, the problem is seemingly worse in 'secular' India than in sharia-influenced Pakistan. (Note: Jaffrelot is a Senior Research Fellow at the Centre for International Studies and Research, while Krishnaswamy is the Dr B R Ambedkar Visiting Professor of Indian Constitutional Law at the Centre.)
