A Critical Analysis of the Self-Determination of Peoples

A Cosmopolitan Perspective

This paper offers an analysis of the concept of national self determination. It outlines three different meanings of the term "self determination" and demonstrates how each would benefit from a cosmopolitan world legal order. The author argues that to be put into full effect, the right to self determination cannot be self-assessed by conflicting political communities. He concludes by suggesting a way of recovering all that is viable in each of the three meanings of the self determination of peoples by urging the conflicting parties to accept the judgment of independent third authorities.
